Prenuptial Agreement Template

This Prenuptial Agreement (the “Agreement”) is made on [Date] by and between [Party A] and [Party B] (together, the “Parties”).

1. Disclosure

Each Party affirms that they have disclosed assets, liabilities, and income as listed in Exhibit A and Exhibit B.

2. Separate Property

Each Party will retain ownership of property listed in their respective exhibits. Separate property includes assets owned before marriage and listed gifts or inheritances.

3. Marital Property

Property acquired during the marriage will be treated as [Marital/Separate] as specified in Exhibit C.

4. Debts

Each Party is responsible for debts listed in Exhibit D. Joint debts, if any, are listed in Exhibit E.

5. Support

No waiver of any provision of this Agreement will be deemed or will constitute a waiver of any other provision, nor will any waiver constitute a continuing waiver unless otherwise expressly stated.

11. Independent Legal Advice

Each Party acknowledges having had the opportunity to seek independent legal advice regarding this Agreement.
